The project management skill of Underestimated Diamond is built to provide clients the visibility and open opportunities for development. Underestimated Diamond creates proposals for clients to get an overview of the goals, objectives, investment, and payment options from research and operations at the initial consultation. Underestimated Diamond is responsible for providing services not the outcome of the results.

Non-Disclosure
Underestimated Diamond provides a non-disclosure agreement that lists the details and terms in relation to any contract, proposals, or even subcontracted parties hired and/or partnered with Underestimated Diamond. Any information provided to Underestimated Diamond will be classified as confidential material and can only be disclosed with the written permission of all parties involved.

This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations, and understandings. This Agreement may not be amended except in a writing signed by both parties. The failure to abide by the agreement can result in an immediate termination of services, forfeiting any financial agreements, and remaining balances would still be owed. Please be advised that any unresolved disputes can go into mediation (discussion) before going to arbitration (court). If there is no mediation then the disputes will go directly to arbitration (court).

Investment & Payment Options

As stated previously, Underestimated Diamond creates proposals for clients to get an overview of the goals, objectives, investment and payment options from research and operations at the initial consultation. Proposals provide a potential timeline to allow clients to track performance and see the results in our efforts.

Payment
Upon the acceptance of the proposed agreement, the first installment of payment will be issued and the remaining stated valid payments will be set up for an extended period agreed by both parties. Underestimated Diamond will provide clients with a user-friendly invoicing system to allow payment transactions online and clients will be able to check their balance at any time.

All prices stated or quoted in proposals on the services of Underestimated Diamond are subject to change at any time and it is your responsibility to frequently check for updated pricing.

Due to the nature of the information and product provided, Underestimated Diamond does not provide refunds. Payments cover the development, time, research, and operations as well as the purchased service and/or product through this website, therefore no refund will be given.

Failure to pay the invoice can result in the suspension of services.

Consumer Payment Agreement

When the consumer authorizes the payment of the invoiced amount to Underestimated Diamond. They have accepted the services of Underestimated Diamond upon payment. Payment confirms that the invoice is a legal and legitimate transaction.

The consumer has accepted the responsibility that if the consumer decides to decline payment after the transaction and work is completed this will result in a fraudulent claim (breach of contract). By the action of breach of contract against the payment authorization, it will intentionally imply my action of fraud against the merchant can result in legal action. Underestimated Diamond has the right to then take legal action against payment and additional fees to gain accrued during the dispute process.

Cancellations / Termination of Services
Underestimated Diamond or client may cancel services if the other party breaches contract. Clients must understand that cancellations of the service MUST be written. PHONE CALLS ARE NOT A RELIABLE RECEIPT OF A CANCELLATION. Client is responsible for the remaining balances pending and/or outstanding on the invoices. As stated previously, Underestimated Diamond does not provide refunds.

Underestimated Diamond provides web design services for clients. After the initial consultation, a proposal and invoice will be provided to the client that includes the details of the prospective website. Client is responsible to read the proposal and invoice to its entirety.

Payment

Outstanding Payments
Websites are attached to third party services such as GoDaddy and other hosting sites. Underestimated Diamond is not responsible should client fail to make payments to this services. Failure to make payments can result in losing content for a while from the company. Your site will eventually disappear from search results. Usually after 30 days, the content might be impossible to achieve will result in creating a new website. We can't guarantee that your content will still be available. In the case of loss content, client will charged to recreate a new website.

Failure to pay invoices will result in a suspension of web maintenance service. Underestimated Diamond will not responsible for any missed deadlines or changes on website until the outstanding balance has been made current.

IMPORTANT NOTICE:
Consumer Payment Agreement:
Client hereby authorize the payment of the invoiced amount to Underestimated Diamond. Client has accepted the services of Underestimated Diamond upon payment. Client understands that this is a legal and legitimate transaction. Client has accepted the responsibility that if the client decides to decline payment after transaction and work completed will result in fraudulent claim (breach of contract) against Underestimated Diamond. By action of breach of contract against the payment authorization will intentionally imply my action of fraud against the merchant that can result to a legal action. Underestimated Diamond has the right to then take legal action against payment and additional fees gain accrued during dispute process.

Conflict of Interest

Underestimated Diamond is entitled to refuse services should client provide information that may be offensive, derogatory, vulgar, pornographic, sexist, and discriminatory to an organization, race, culture, ethnicity, religion, event, gender, disability or sexual orientation. Client forfeits payments already received.

Be advised that all comments are always welcome on blog posts but Underestimated Diamond has reserve the right to remove comments that are inappropriate, disrespectful or too promotional. Please note that if your comment contains too many links, vulgar language, or advertisement it may automatically be flagged as spam and you may blocked from posting on Underestimated Diamond websites and all social media outlets.

Insurance, Assurance, and Formalities

Underestimated Diamond does not have the right to change or misrepresent the client’s service. Underestimated Diamond is entitled to proceed with legal action should client use services as a defamation or character or sexual harassment towards the Underestimated Diamond.

Breach of contract is a failure to abide by the contract services including fees and representation and can result to a legal cause of action. The binding agreement and/or the contractual promise have not been honored.

Privacy

Privacy
By using the services and use of the site of Underestimated Diamond, you agree to the privacy policy and understand that it is your responsibility to periodically check this policy for updates and modifications. Underestimated Diamond is strongly committed to protecting your privacy online.

Underestimated Diamond is a sole proprietorship and all materials including writings, poems, pictures, and other promotional materials are legally copyrighted.

If any provision of this agreement becomes void, unlawful, or unenforceable, then that provision will be excluded from this agreement and will not affect the validity and enforceability of any remaining provisions. All contracts are legal documents under the jurisdiction of the Commonwealth of Massachusetts and Florida Statutes.
